Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Guitartopia (“Guitartopia”, “we”, “us”, or “our”) and govern your access to and use of the Guitartopia website, applications, and related services (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority in your country, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

2. Your account

You may sign in using an email and password or with a supported third-party identity provider (such as Google). You are responsible for keeping your credentials secure and for activity that occurs under your account. Provide accurate information and keep it current. You may close your account at any time using the in-product controls or by contacting us.

3. License to use the Service

Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to access and use the Service for your own non-commercial use. We retain all rights in the Service that are not expressly granted to you.

4. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or attempt to derive the source of the Service.
  • Use the Service to infringe intellectual-property or privacy rights.
  • Upload or transmit unlawful, harmful, harassing, or sexually explicit content.
  • Interfere with the Service’s operation, including via scraping, denial-of-service, or attempts to bypass rate limits or access controls.
  • Resell, redistribute, or otherwise commercialise access to the Service.
  • Use the Service to train machine-learning models without our prior written consent.

5. User content

You retain ownership of any content you upload or create through the Service (“User Content”). You grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and display User Content solely as necessary to operate, secure, and provide the Service to you. We do not claim ownership of your recordings or other submissions, and we do not sell User Content to third parties.

You are responsible for the legality of the content you upload. You confirm that you have the rights necessary to share that content and to grant the licence above.

6. Paid plans, billing, and refunds

Some features are offered through paid subscriptions. Pricing, billing intervals, and the scope of each plan are described on our pricing page. Payments are processed by a third-party payment provider; we do not store your full card details on our servers.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

7. Free plan and changes to the Service

We may modify, suspend, or discontinue features of the Service at any time. Where a change materially reduces a paid feature you rely on, we will give you reasonable notice and, where appropriate, a pro-rated refund or credit.

8. Intellectual property

Other than User Content, the Service - including its code, design, copy, artwork, logos, and trade marks - is owned by Guitartopia or its licensors and is protected by intellectual-property laws. These Terms do not transfer any of those rights to you.

9. Termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that creates risk for us or other users. You may stop using the Service at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will continue to apply.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, free from errors, or that any educational content will achieve a particular outcome. The Service is not a substitute for professional advice.

11. Limitation of liability

To the maximum extent permitted by law, Guitartopia and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or in connection with your use of the Service. Our total cumulative liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $50.

12. Indemnity

You agree to indemnify and hold harmless Guitartopia from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Guitartopia is established, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to the Service will be brought exclusively in the courts of that jurisdiction, except where local consumer-protection law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Continuing to use the Service after the effective date of an update means you accept the updated Terms.
